U.S. Court of Appeals Case No: 05-4347
Western District of Missouri
[PUBLISHED] [Bowman, Author, with Wollman and Riley, Circuit Judges]
Civil Case - social security. Commissioner of Social Security
appeals district court's decision reversing denial of benefits.
Decision to deny benefits was supported by substantial evidence and
district court's decision is reversed. District court erred in
rejecting ALJ's credibility findings related to complaints of back
pain. ALJ properly considered complaints of pain and found independent
reasons, each supported by substantial evidence, to discredit complaints.
Substantial evidence supports decision to rely on assessment that
claimant retained residual functional capacity to perform past relevant
work. Decision to deny benefits is reinstated.
