U.S. Court of Appeals Case No: 05-4373
District of Nebraska
[PUBLISHED] [Melloy, Author, with Murphy and Gruender, Circuit Judges]
Criminal Case - conviction and sentence. District court did not clearly
err in finding police had probable cause to stop automobile and search
defendant's person, based on reasonable belief defendant was driving
with a suspended license and search of defendant's person was lawful
search incident to arrest. Search of engine compartment did not violate
state law or police policy and was incident to inventory search; search
was within scope of reasonable inventory search. Sentence was not
unreasonable.
