U.S. Court of Appeals Case No: 05-4434
District of Minnesota
[PUBLISHED][Melloy, Author, with Murphy and Colloton, Circuit Judges]
Criminal Case - conviction and sentence. Conviction for possessing
a firearm as a previously convicted felon was supported by sufficient
evidence. District court did not abuse its discretion in admitting
evidence of prior convictions for impeachment purposes, the scope of
the cross examination was proper, and the jury instruction did not
constitute plain error. District court did not err in finding prior
convictions for theft of vehicle and escape constituted crimes of
violence and defendant was properly sentenced as an armed career
criminal. Conclusion defendant possessed a firearm in connection
with a crime of violence was not error.
