Civil case - civil rights. Even if plaintiff did establish a prima facie
case of intentional discrimination in defendant's decision not to hire him
for a permanent position, he failed to present evidence sufficient to
support a finding that the defendant's stated reasons for declining to hire
him were a pretext for race and national origin discrimination; while there
was a temporal proximity between plaintiff's complaint of discrimination
and the decision not to hire him for a permanent position, he failed to
show the stated reasons for the hiring decision were a pretext for
retaliation since the actions relied on in defendant's stated reasons
preceded the complaint; on plaintiff's claim of hostile work environment,
the district court did not err in granting the defendant's motion for
summary judgment as plaintiff failed to show defendant did not respond
to the harassment in a prompt and efficient manner. Judge Heaney,
dissenting.
