U.S. Court of Appeals Case No: 05-4483
Eastern District of Missouri
[PUBLISHED] [Melloy, Author, with Murphy and Colloton, Circuit Judges]
Criminal case - Sentencing. Eighty-four month sentence, which
amounted a 104 month downward variance from the lowest end of the
applicable Guidelines range, was not justified by compelling
circumstances; while Guidelines Sec. 4A1.2(b)(1), which limits the
extent of traditional departures for career criminals, does not strictly
limit the scope of variances post-Booker, it remains relevant to consider
the Guidelines and the commentary in any assessment of reasonableness,
and these sources do not support the extent of the variance in this case.
