U.S. Court of Appeals Case No: 05-6035
Eastern District of Missouri
[PUBLISHED] [Kressel, Author, with Federman and Venters, Bankruptcy Judges]
Bankruptcy Appellate Panel. Finding that debtor had participated in a
conversion of a portion of a probate estate is affirmed in part and reversed
in part; as the evidence showed another person was the only one
authorized to transfer certain funds and that he was the only one who
acted to accomplish the transfer, debtor could not be liable for converting
these funds; another portion of the funds was garnished by a third person
and debtor was not liable for converting these funds; however, debtor did
personally withdraw $40,000 from the estate and she is liable for
converting those funds.
