U.S. Court of Appeals Case No: 05-6052
District of North Dakota
[PUBLISHED] [Schermer, Author, with Federman and McDonald,
Bankruptcy Judges]
Bankruptcy Appellate Panel. Bankruptcy court did not err in
subordinating Bala's administrative expense claim to the claims of the
other debtors, as Bala's misconduct as debtor's founder and sole
shareholder injured the other creditors and justified equitable
subordination of her claims.
