U.S. Court of Appeals Case No: 05-6058
Eastern District of Arkansas
[PUBLISHED] [Federman, Author, with Mahoney and McDonald,
Bankruptcy Judges]
Bankruptcy Appellate Panel. Debtor was estopped from asserting the
deficiencies in her petition and schedules because she enjoyed the
benefits of filing the petition and had shown a complete disregard for her
creditors; further, debtor knew of the deficiencies and waited more than
10 weeks to bring them to the court's attention, during which time she
filed numerous pleadings indicating her desire to continue with the
bankruptcy proceedings; based on debtor's misconduct, the bankruptcy
court did not abuse its discretion in denying her motion to convert the
case to a Chapter 11.
