U.S. Court of Appeals Case No: 06-1115
U.S. District Court for the Eastern District of Arkansas - Little Rock
[PUBLISHED] [Melloy, Author, with Benton and Shepherd, Circuit Judges]
Criminal case - Sentencing. Defendant had adequate notice of the
government's intent to seek an upward departure based on uncharged
conduct; district court did not err in granting an upward departure under
Guidelines Sec. 5K2.21; while the upward departure of almost 100% was
extraordinary, it was justified by extraordinary circumstances and was not
unreasonable.
