U.S. Court of Appeals Case No: 06-1129
District of Minnesota
[PUBLISHED] [Arnold, Author, with Bye and Melloy, Circuit Judges]
Civil case - Employment Discrimination. Plaintiff failed to make a
prima facie case of age discrimination where his permanent successor
was only two-and-a-half years younger than he; even if plaintiff did make
a prima facie case, he failed to show the legitimate, non-discriminatory
reasons the university advanced for its decision to demote him were
pretexts for age discrimination; plaintiff failed to make a prima facie
case of retaliation as he failed to create a material issue of fact as to
a causal connection between his demotion and any protected activity in
which he engaged.
