Civil case - Insurance. Source Food did not experience direct physical
loss when the U.S. border was closed to its product as a result of an
outbreak of Mad Cow Disease in Canada, and Source Foods could not
recover the loss of business income resulting from the embargo on beef
products under the insurance policy provisions requiring direct physical
loss to its property.

Civil Case - insurance. Grant of summary judgment to insurer on claim
for coverage under business interruption policy is reversed. Due to
Canadian beef embargo, loss of customer constituted a direct physical
loss under the policy because business was stopped; government
regulation, not actual contamination rendered beef unusable. Judge
Gruender dissents.
