Criminal Case - new trial. District court's grant of a new trial based on
use of perjured testimony is reversed. There being no evidence that the
government knew the witness's testimony was perjured, defendant's due
process rights were not violated. Assuming grant of new trial was based
on district court's conclusion that verdict was against the weight of the
evidence, district court abused its discretion in granting new trial in light
of overwhelming evidence supporting verdict.
