U.S. Court of Appeals Case No: 06-1364
U.S. District Court for the Northern District of Iowa - Sioux City
[PUBLISHED] [Riley, Author, with Murphy and Hansen, Circuit Judges]
Criminal case - Sentencing. In a case involving a felon in possession
of a firearm, the district court erred in not imposing an enhancement
under Guidelines Sec. 2K2.1(b)(5) where the evidence showed defendant
obtained the weapon as collateral for loaning money to a man in order
to permit the man to buy drugs and sell drugs so he could repay a debt
he owed defendant; when defendant falsely denied relevant conduct, the
district court erred in granting an acceptance-of-responsibility
reduction.
