U.S. Court of Appeals Case No: 06-1413
Western District of Arkansas
[PUBLISHED] [Arnold, Author, with Beam, Circuit Judge and Doty, District
Judge]
Civil Case - civil rights. In civil rights action brought by decedent's
mother, rather than all of decedent's heirs, mother lacked standing and
district court properly granted dismissal. District court did not abuse
its discretion in denying motion to amend, as the original complaint was
a nullity and could not serve as a foundation for an amendment; claims
in amendment on their own were barred by the statute of limitations.
