U.S. Court of Appeals Case No: 06-1414
U.S. District Court for the Southern District of Iowa - Des Moines
[PUBLISHED] [Gruender, Author, with Loken, Chief Judge, and
Smith, Circuit Judge]
Civil case - Employment Discrimination. Giving all reasonable
inferences to the jury's verdict in favor of plaintiff, plaintiff established
a prima facie case of disability discrimination, and the defendant was not
entitled to judgment as a matter of law on the claim; evidence was
sufficient for the district court to submit the issue of punitive damages to
the jury, as there was evidence defendant acted with malice or reckless
indifference when it made its hiring decision; district court did not abuse
its discretion in denying defendant's motion to remit the jury's award of
back pay, as the evidence was sufficient to support a finding that plaintiff
mitigated his damages; award of one year's worth front pay was not an
abuse of discretion.
