U.S. Court of Appeals Case No: 06-1435
U.S. District Court for the District of Minnesota - Minneapolis
[PUBLISHED] [Arnold, Author, with Bye and Melloy, Circuit Judges]
Civil case - Whistleblower Statute. Plaintiff failed to establish
a causal connection between his protected activity and the defendant's
decision to terminate him; while temporal proximity may occasionally
raise an inference of causation, in general, more than temporal
connection is required, and here the presence of intervening events
undermined any causal inference which could be drawn from the timing.
