U.S. Court of Appeals Case No: 06-1552
District of South Dakota
[PUBLISHED] [Bye, Author, with Lay and Riley, Circuit Judges]
Criminal case - criminal law. District court did not err in admitting
testimony from a forensic examiner concerning the minor victim's
statements; the minor victim's testimony was at times unclear and
inconsistent and the out-of-court statements she made to the examiner
were the most probative evidence available under Rule 807.
