U.S. Court of Appeals Case No: 06-1609
District of Nebraska - Lincoln
[PUBLISHED] [Riley, Author, with Hansen and Smith, Circuit Judges]
Civil case - employment discrimination. Shift rotation was a non-
discriminatory essential function of plaintiff's job and his restriction
to straight shift work rendered him unqualified to perform all of the
essential functions of the job; as a result, the district court did not
err in granting the defendant's motion for summary judgment on plaintiff's
ADA claim.
