U.S. Court of Appeals Case No: 06-1626
U.S. District Court for the Eastern District of Missouri - St. Louis
[PUBLISHED] [Smith, Author, with Melloy and Benton, Circuit
Judges]
Civil Case - declaratory judgment. District court's grant of judgment as
a matter of law is affirmed, as no rational jury would be able to reconcile
the difference between the stated value of property in bankruptcy and the
insurance claim less than one year later and the only reasonable inference
on the evidentiary record is that insured made a material
misrepresentation in submitting claim; thus, insurance company is
entitled to judgment.
