U.S. Court of Appeals Case No: 06-1652
District of North Dakota
[PUBLISHED] [Arnold, Author, with Bye and Melloy, Circuit Judges]
Criminal case - criminal law. Police did not seize the Federal Express
package until they had a drug dog alert which provided a sufficient

of North Dakota Rule of Criminal Procedure 41(d) was neither deliberate
nor prejudicial and did not require suppression of the package.
