Civil case - civil rights. Chief Medical Officer of the State of
Nebraska was entitled to absolute immunity on claim use of a hearing
officer to conduct proceedings on complaints under the Nebraska
Licensing Law violates plaintiff's civil rights; such protection is
necessary so that the Chief Medical Officer can perform his functions
without harassment or intimidation; the Chief Medical Officer's absence
at the hearing does not deprive plaintiff of due process because the
disciplinary procedures used contain adequate safeguards. Judge Beam,
concurring.
