Civil case - civil rights. District court did not err in finding
that any issue actually decided in a non-merits dismissal should be given
preclusive effect in a subsequent action between the same parties, and it
did not err in holding that the immunity rulings in the previous action
precluded further litigation on those issues; with respect to the issue of
municipal liability under Section 1983, the district court did not err in
granting the city's motion for summary judgment; individual officers were
entitled to qualified immunity in their individual capacities.
