U.S. District Court for the District of Minnesota - Minneapolis
[PUBLISHED] [Melloy, Author, with Chief Judge Loken, Circuit
Judges, as two-judge panel]
Civil Case - diversity. Grant of summary judgment to employer on claim
of retaliation under the Minnesota Whistleblower Act is affirmed.
Assuming employee met the good faith and reporting requirements,
employer proffered legitimate reasons for the employee's termination,
which the employee failed to show were pretextual. The district court did
not abuse its discretion in denying motion to amend scheduling order to
permit filing of a motion for sanctions against plaintiff's counsel.
