U.S. Court of Appeals Case No: 06-1781
U. S. District Court for the Northern District of Iowa - Dubuque
[PUBLISHED] [Colloton, Author, with Bye and Benton, Circuit Judges]
Criminal Case - sentence. Nine-level increase in advisory guideline
range to statutory maximum was not unreasonable. District court erred
in fusing the departure and variance considerations together, but error
was harmless. Substantial deviation from advisory benchmark sentence is
justified by exceptional circumstances of the case including the extent
the perjury impeded the administration of justice and finding that
defendant was a dangerous person.
