U.S. Court of Appeals Case No: 06-1785
U.S. District Court for the Northern District of Iowa - Cedar Rapids
[PUBLISHED] [Riley, Author, with Wollman and Gruender, Circuit
Judges]
Criminal case - criminal law. District court did not err in denying
defendant's motion to dismiss for pre-trial delay as the motion, which was
made just before closing arguments, was untimely; even if the motion
was not considered to be untimely, it was properly denied as defendant
failed to show any actual and substantial prejudice from the delay; under
the circumstances of the case, the district court did not err in refusing to
give defendant's proposed "addict-informer" instruction.
