U.S. Court of Appeals Case No: 06-1918
U.S. District Court for the Western District of Missouri - Kansas City
[PUBLISHED] [Murphy, Author, with Loken, Chief Judge, and John
R. Gibson, Circuit Judge]
Civil case - civil rights. Plaintiffs created a genuine issue of material
fact as to whether defendant's employee interfered with their rights under
Section 1981; while there is no evidence of discriminatory policies or
discriminatory acts by managers for which Dillard's could be liable,
plaintiffs created a genuine issue of material fact as to whether Dillard's
was negligent in failing to stop employee's behavior; the case is remanded
for further proceedings.
