Civil case - civil rights. Plaintiffs created a genuine issue of material fact as to whether defendant's employee interfered with their rights under Section 1981; while there is no evidence of discriminatory policies or discriminatory acts by managers for which Dillard's could be liable, plaintiffs created a genuine issue of material fact as to whether Dillard's was negligent in failing to stop employee's behavior; the case is remanded for further proceedings.
