U.S. Court of Appeals Case No: 06-1942
U.S. District Court for the District of Minnesota - Minneapolis
[PUBLISHED] [Smith, Author, with Bowman and Colloton, Circuit Judges]
Civil Case - Equal Access Act. District court's grant of preliminary
injunction to Straights and Gays for Equality for same access for
meetings, avenues of communication and other miscellaneous rights
afforded to other curricular groups in high school was not an abuse of
discretion. SAGE was likely to prevail that it was not afforded same
rights as other noncurriculum related groups and was entitled to
presumption of irreparable harm.
