U.S. Court of Appeals Case No: 06-1965
U.S. District Court for the District of Minnesota - Minneapolis
[PUBLISHED] [Loken, Author, with Lay and Melloy, Circuit Judges]
Civil case - Employment discrimination. The district court did not err
in finding plaintiff was not entitled to protection under the Minnesota
Whistleblower's statute as there was no evidence to demonstrate plaintiff
made a report for the purpose of exposing a previously unknown
illegality; plaintiff did not make a prima facie case of pregnancy
discrimination as the circumstances surrounding her alleged termination
did not give rise to an inference of discrimination; defamation claim was
properly dismissed as there was no provable false statement of fact;
battery claim was properly dismissed as plaintiff's sole remedy for a
workplace battery is the Minnesota Workers Compensation Act.
