U.S. Court of Appeals Case No: 06-1983
U.S. District Court for the District of Minnesota - Minneapolis
[PUBLISHED] [Chief Judge Loken, Author, with Melloy, Circuit
Judge]
Civil Case - civil forfeiture. Grant of summary judgment in
forfeiture action of clubhouse owned by Minnesota Church of Angels
and used by Hell's Angels Motorcycle Club is reversed, as conflict
in testimony created a genuine issue of material fact. Under Civil
Asset Forfeiture Reform Act, government must prove substantial
connection between property; evidence in this case was not unrefuted
and called into doubt the credibility of the government witnesses.
