Civil Case - diversity jurisdiction. District court's denial of motion to
remand diversity case based on fraudulent joinder is reversed. Claim
against owner of vehicle for negligence in providing the truck to be used
on the highway with inadequate and defective tires provided a reasonable
basis for believing state might impose liability sufficient to defeat
fraudulent joinder challenge. Dismissal of claim against truck owner is
reversed and case is remanded to state court.
