U.S. Court of Appeals Case No: 06-2030
U.S. District Court for the Western District of Missouri - Kansas City
[PUBLISHED] [Gruender, Author, with Bye and Bowman, Circuit Judges]
Criminal case - criminal law. Since the federal agents involved in the search were participating in their role as permanent members of a Kansas City Police drug task force, Rule 41 did not apply, and the warrant in this case did not have to be issued by a federal magistrate; affidavits established probable cause for a search of defendant's home; protective sweep of defendant's vehicle was lawful; any error in seizing documents in the vehicle which were not described in a subsequently-issued warrant was harmless.
