U.S. Court of Appeals Case No: 06-2036
U.S. District Court for the Southern District of Iowa - Des Moines
[PUBLISHED] [Gruender, Author, with Wollman and Riley, Circuit
Judges]
Criminal Case - conviction and sentence. Evidence was sufficient that
defendant knowingly possessed a firearm, as defendant had dominion and
control over house where firearm was stored and defendant knew firearm
was located there. District court did not err in calculating advisory
guidelines sentence, as prior felony conviction for driving while
intoxicated qualifies as a violent felony when defendant was the driver.
District court did not err in determining there were 3 firearms, as court
may make finding of fact at sentencing when it presided over trial and
evidence supported constructive possession of at least one additional
firearm
