Criminal Case - conviction. District court did not err in concluding
search warrant was not fatally stale after two months because defendant
was incarcerated and could not dispose of evidence and testimony
supported continued presence of property. District court did not
abuse its discretion in admitting bad acts evidence of the rifle and
testimony concerning its origin, as rifle evidence was relevant to
show relationship and knowledge. District court abused its discretion
in admitting hearsay testimony under Rule 801(d)(1)(B), but error was
harmless because testimony was cumulative.
