U.S. Court of Appeals Case No: 06-2142
U.S. District Court for the Eastern District of Arkansas - Jonesboro
[PUBLISHED] [Benton, author, with Murphy and Arnold, Circuit
Judges]
Civil Case - social security. District court retained jurisdiction following
a sentence six remand to the Commissioner for further review and thus
the dismissal for failure to exhaust administrative remedies was error. On
the merits, ALJ did not err in discounting opinions of treating physicians
that were inconsistent, did not err in discounting subjective complaints of
pain during relevant period and did not err in relying on equivocal
response to hypothetical.
