U.S. Court of Appeals Case No: 06-2157
U.S. District Court for the Northern District of Iowa - Cedar Rapids
[PUBLISHED] [Bye, Author, with John R. Gibson and Gruender, Circuit
Judges]
Criminal case - Sentencing. District court recommendation that
defendant, a child pornographer, undergo sex offender treatment while
incarcerated is not binding on the BOP, and is unreviewable on appeal;
supervised release conditions, such as registration and limiting contact
with minors, were not clearly erroneous; condition requiring defendant to
undergo mental health evaluation and treatment as determined by his
probation officer was not an improper delegation of authority as the judge
retained authority over the issue.
