Civil case - contracts. Plaintiff was equitably estopped from pursuing
claims for retainer fees defendant's former clients, now plaintiff's
current clients, had paid defendant; defendant's partner, who had been
a partner at plaintiff before he brought the clients to defendant, had
informed defendant that sufficient work had been done in each case to
consider the fees earned and distributable to the members of the
partnership, and he could not now take an inconsistent position and
assert the fees had not been earned; plaintiff could not disassociate
itself from the actions of the partner.
