U.S. Court of Appeals Case No: 06-2227
District of Nebraska - Omaha
[PUBLISHED] [Smith, Author, with Riley and Beam, Circuit Judges]
Criminal case - Criminal law. Defendant's appeal waiver did not
preclude his challenge to the imposition of jury costs; under the
law of this circuit a district court may only impose costs authorized
under 18 U.S.C. Sec. 1920, and Nebraska Local Rule 31.2 authoring the
imposition of the costs is inconsistent with federal law; as a result,
the district court erred in imposing the jury costs in the case.
Judge Beam, dissenting.
