U.S. Court of Appeals Case No: 06-2245
U.S. District Court for the Southern District of Iowa - Des Moines
[PUBLISHED] [Gruender, Author, with Wollman and Riley, Circuit
Judges]
Criminal case - criminal law. District court erred in suppressing
evidence seized at a traffic stop, as the traffic stop in the case was lawful
and, even if it was not, defendant's voluntary consent to the search of his
automobile purged any arguable taint; police officer had an objectively
reasonable basis for believing defendant had violated Iowa Code Sec.
321.306 concerning operating a vehicle safely in a single lane.
