U.S. Court of Appeals Case No: 06-2273
U.S. District Court for the District of Minnesota - Minneapolis
[PUBLISHED] [Wollman, Author, with Riley and Shepherd, Circuit
Judges]
Civil case - ERISA. In action under Section 510 of ERISA,
plaintiff failed to make a prima facie case that his employer
had discharged him for the purpose of interfering with his
benefits, as plaintiff failed to show that he suffered an adverse
employment action; plaintiff's claim that he was constructively
discharged from his position when the employer created a
performance-improvement-plan for him was not supported by
the evidence.
