In action under Section 510 of ERISA, plaintiff failed to make a prima facie case that his employer had discharged him for the purpose of interfering with his benefits, as plaintiff failed to show that he suffered an adverse employment action; plaintiff's claim that he was constructively discharged from his position when the employer created a performance-improvement-plan for him was not supported by the evidence.
