U.S. Court of Appeals Case No: 06-2286
and No: 06-2301
U.S. District Court for the Eastern District of Missouri - St. Louis
[PUBLISHED] [Riley, Author, with Wollman and Shepherd, Circuit
Judges]
Civil case - Declaratory Judgment. District court did not err in finding
that Washington University was the owner of the biological samples and
that neither defendant Catalona nor the donors had any ownership interest
in the samples; district court did not err in concluding that the
donors made informed and voluntary decisions to participate in genetic
cancer research and that they donated their biological materials to the
school as valid inter vivos gifts.
