U.S. Court of Appeals Case No: 06-2315
U.S. District Court for the Western District of Missouri - St. Joseph
[PUBLISHED] [Benton, Author, with Melloy and Smith, Circuit
Judges]
Civil case - employment discrimination. District court did not abuse its
discretion in allowing defendant to introduce after-acquired evidence that
plaintiff had misrepresented her education on her job application; nor did
the court err in refusing to allow plaintiff to introduce evidence relating to
what she contended was disparate treatment of white employees, as those
incidents involved different decision makers; district court did not abuse
its discretion in setting a time limit on the presentation of the evidence.
Judge Smith, concurring in part and dissenting in part.
