U.S. Court of Appeals Case No: 06-2320
District of Nebraska - Omaha
[PUBLISHED] [Criminal case - criminal law.
Criminal case - criminal law. Omitting the details and existence of a
confidential informant agreement between the police and the confidential
informant was not misleading and did not materially change the
informant's apparent reliability or render the warrant application
misleading; in light of informant's extensive history as a reliable
informant and the officer's personal observation of informant, the
supplementation of the affidavit with additional information concerning
informant's conviction on misdemeanor charges would not alter the
probable cause finding and would not warrant a Franks hearing.
