Civil Case - diversity - negligence. Review of dismissal of negligence
and negligent misrepresentation claims is precluded by absence of
transcript of district court proceedings. Denial of motion to exclude
expert is denied as moot. Disqualification of counsel at pretrial stage was
an abuse of discretion but error was harmless because there was no
showing what original attorney would have done or how they were
prejudiced by substitute counsel. Costs to defendants was not an abuse of
discretion because defendants prevailed before voluntary dismissal of
remaining claims.
