U.S. Court of Appeals Case No: 06-2410
U.S. District Court for the Southern District of Iowa - Des Moines
[PUBLISHED] [Arnold, Author, with Murphy and Benton, Circuit
Judges]
Criminal case - Sentencing. District court did not abuse its discretion
by imposing conditions of supervised release requiring a defendant
convicted of a firearms offense to participate in sex offender treatment
and submit to polygraph testing, as defendant had a recent criminal
history of sex offenses, the conditions were a limited restriction on his
personal liberty and the provisions were reasonably related to the need to
protect the public from future crimes; conditions were not an improper
delegation of authority to the probation office as the court retained
ultimate responsibility.
