U.S. District Court for the District of Minnesota - Minneapolis
[PUBLISHED] [Murphy, Author, with Hansen and Gruender, Circuit
Judges]
Civil Case - diversity - whistleblower retaliation. Employee's job duties
required her to ensure compliance with applicable laws and she did not
become a whistleblower by exercising her duties to report noncompliance
under Minnesota whistleblower statute. Because she did not engage in
statutorily protected conduct, the district court's grant of summary
judgment was proper. Cross-appeal challenging whether employee
suffered an adverse employment action is denied as moot.
