U.S. Court of Appeals Case No: 06-2481
U.S. District Court for the District of Minnesota - Minneapolis
[PUBLISHED] [Smith, Author, with Wollman and Benton, Circuit
Judges]
Civil Case - diversity. District court's dismissal of complaint for failure
to prove amount in controversy is reversed, as a reasonable jury could
award $66,000 in damages for the value of property stolen and punitive
damages of at least $9,000 to meet the jurisdictional threshold. With
diversity jurisdiction established, district court had supplemental
jurisdiction over all other claims except those dismissed for failure to
state a claim. Theft, receiving stolen property and attorney's fees claims
were all properly dismissed for failure to state a claim.
