U.S. Court of Appeals Case No: 06-2482
U.S. District Court for the District of Minnesota - Minneapolis
[PUBLISHED] [Smith, Author, with Murphy and Hansen, Circuit
Judges]
Civil case - Employment discrimination. Conduct of the residents of
juvenile correctional facility could not be attributed to the employer to
show that the harassment affected a term, condition or privilege of
employment; conduct of plaintiff's co-workers, while offensive, juvenile
and inappropriate for the workplace, was not so severe or pervasive as to
affect a term, condition or privilege of employment; requirement that
plaintiff obtain supervisor approval before disciplining inmates would not
likely dissuade a reasonable employee from making or supporting a
charge of discrimination and did not establish retaliation; co-workers'
conduct did not create objectively intolerable working conditions and did
not support a claim of constructive discharge.
