Civil case - Employment Discrimination. District court did not err in
granting summary judgment for defendant Fred's Inc., as the record
showed that entity was not plaintiff's employer; defendant Fred's of
Tennessee was not entitled to judgment as a matter of law on plaintiff's
Equal Pay Act claims as a reasonable juror could have found that the pay
differences between plaintiff and Fred's male employees were not based
on factors other than gender; no error in awarding liquidated damages
under the Pay Act, as there was sufficient evidence for a reasonable jury
to find Fred's acted willfully and without reasonable grounds for
believing its conduct was lawful.
