U.S. Court of Appeals Case No: 06-2519
and No: 06-2630
U.S. District Court for the Eastern District of Arkansas - Little Rock
[PUBLISHED][Gruender, Author, with Loken, Chief Judge, and
O'Connor, Associate Justice (Ret.)]
Prisoner case - habeas. Evidence in the state court record was more
than sufficient to support the Arkansas Supreme Court's determination
that Collier failed to show Brady prejudice because the suppression of
evidence which could have been used to impeach a state's witness was
not sufficient to create a reasonable probability that the trial would have
had a different outcome if Collier had been aware of the evidence;
Arkansas Supreme Court did not engage in an unreasonable application
of Brady in reaching that decision; Arkansas Supreme Court disposed of
Collier's Rule 37 petition based on an independent and adequate state
procedural rule, and Collier's failure to show cause and prejudice or
actual innocence meant he had forfeited his right to raise claim in federal
court.
