U.S. Court of Appeals Case No: 06-2556
U.S. District Court for the District of South Dakota
[PUBLISHED] [Bye, Author, with Colloton and Benton, Circuit
Judges]
Civil Case - employment discrimination. District court's grant
of summary judgment on race and retaliation claims are affirmed.
Employee did not establish that the actions taken against her
individually or cumulatively constitute or rise to the level of
an adverse employment action or a material employment disadvantage
on the race claim. Employee has not met her burden under Burlington
N & Santa Fe Ry v. White that the employer's retaliatory actions were
materially adverse such that a reasonable employee in her situation
would have been dissuaded from complaining about discrimination.
